⚠️ BETA NOTICE: HustleCashFlow is currently in beta testing. Features may change, and the App is provided "as is" during this period. By using the App during beta, you acknowledge and accept these limitations.
1. Acceptance of Terms
Welcome to HustleCashFlow. These Terms of Service ("Terms") govern your use of the HustleCashFlow mobile application and related services operated by FMD Business Services LLC ("Company," "we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
HustleCashFlow is a personal side hustle finance tracking application designed to help gig workers, freelancers, and side hustlers track income, expenses, mileage, and estimated tax obligations across multiple hustles. HustleCashFlow is NOT a professional accounting service, tax preparation software, licensed financial advisory service, or substitute for professional financial advice.
The App is intended for personal organizational use only. Tax estimates generated within the App are approximations based on user-entered data and should not be used as the sole basis for tax filing. Always consult a qualified tax professional for official tax preparation.
3. Eligibility
To use the App, you must:
• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Provide accurate and complete registration information
• Not be prohibited from using the App under applicable law
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and update your account information as needed
• Notify us immediately of any unauthorized use of your account
• Use only one account per person
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently. Contact us at fmdbusinessservices@gmail.com if you suspect unauthorized access.
5. Acceptable Use
5.1 Permitted Use
You may use the App solely for personal side hustle finance tracking purposes, including logging income, expenses, mileage, and reviewing estimated tax obligations for yourself and your personal side hustles.
5.2 Prohibited Use
You agree NOT to:
• Use the App as a substitute for professional tax preparation or licensed financial advisory services
• Enter bank account credentials, Social Security numbers, or sensitive financial account information into the App
• Use the App for any commercial accounting, bookkeeping, or financial services business purpose without written authorization from the Company
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use the App to transmit spam, malware, or any harmful content
• Impersonate any person or entity or misrepresent your identity
• Use the App in any way that violates applicable laws or regulations
• Share your account credentials with unauthorized third parties
• Attempt to gain unauthorized access to other users' data
6. Beta Program Terms
HustleCashFlow is currently in beta. As a beta user, you acknowledge:
• The App may contain bugs, errors, or incomplete features
• Features may be added, modified, or removed without prior notice
• Data loss, though unlikely, is possible during the beta period
• The Company is not liable for any losses or damages arising from beta use
• Your feedback during beta is welcome and may be used to improve the App
The beta period provides free access to all current features. At the conclusion of the beta period, a subscription plan will be required to continue using paid-tier features.
7. Subscription and Payment
Following the free trial/beta period, continued use of certain features will require a paid subscription. Subscription details including pricing, features per tier, and billing terms will be clearly communicated before any charges are applied.
• Free tier features will remain available at no cost
• Paid tier features require an active subscription
• Annual subscription plans are available at a discounted rate
• Subscriptions auto-renew unless cancelled before the renewal date
• Refund policies will be detailed at the time of subscription enrollment
• Payment processing is handled by Stripe; your payment information is governed by Stripe's privacy policy
8. Financial Data Disclaimer
THE TAX ESTIMATES AND FINANCIAL SUMMARIES GENERATED BY HUSTLECASHFLOW ARE FOR INFORMATIONAL AND ORGANIZATIONAL PURPOSES ONLY. THEY ARE BASED SOLELY ON DATA YOU MANUALLY ENTER AND ARE NOT VERIFIED AGAINST OFFICIAL FINANCIAL RECORDS.
FMD BUSINESS SERVICES LLC IS NOT A LICENSED TAX PREPARER, CERTIFIED PUBLIC ACCOUNTANT, OR REGISTERED INVESTMENT ADVISOR. THE APP DOES NOT PROVIDE PROFESSIONAL FINANCIAL, TAX, OR LEGAL ADVICE. YOU SHOULD CONSULT A QUALIFIED PROFESSIONAL FOR ALL OFFICIAL TAX FILING, FINANCIAL PLANNING, AND LEGAL MATTERS.
FMD Business Services LLC is not responsible for any tax liabilities, penalties, underpayments, or financial losses arising from reliance on data, estimates, or summaries generated within the App.
9. Intellectual Property
All content, features, and functionality of HustleCashFlow, including but not limited to text, graphics, logos, and software, are the exclusive property of FMD Business Services LLC and are protected by United States and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works based on the App without our express written consent.
10. User Content
You retain ownership of any content you enter into the App. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the App's services to you.
You are solely responsible for the accuracy and completeness of all financial data you enter. You agree not to enter any content that is unlawful, harmful, or violates the rights of others.
11. Disclaimer of Warranties
HUSTLECASHFLOW IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FMD BUSINESS SERVICES LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
THE APP IS NOT A PROFESSIONAL FINANCIAL SERVICE, TAX PREPARATION TOOL, OR SUBSTITUTE FOR LICENSED ACCOUNTING ADVICE. THE COMPANY MAKES NO WARRANTIES REGARDING THE ACCURACY OF TAX ESTIMATES OR FINANCIAL SUMMARIES GENERATED BY THE APP.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FMD BUSINESS SERVICES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO ANY FINANCIAL LOSSES, TAX PENALTIES, OR DAMAGES ARISING FROM RELIANCE ON APP-GENERATED ESTIMATES.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless FMD Business Services LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.
14. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
15. Termination
We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms, fraudulent activity, or any other reason at our discretion with or without notice.
You may terminate your account at any time by contacting us. Upon termination, your right to use the App ceases immediately. We will delete your data in accordance with our Privacy Policy.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes through the App or via email. Your continued use of the App after the effective date of changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of New York (USA). Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.
